Search & Seizure
What are your rights?
"...every unjustifiable intrusion by the Government upon the privacy of
the individual, whatever the means employed, must be deemed a violation of the Fourth Amendment."
-Justice Brandeis
(Olmstead v. US)
The Fourth Amendment guarantees the right to individual privacy and prohibits unreasonable searches or seizures by the government. Increasingly, drug laws infringe upon these rights by allowing invasive drug testing and weapons searches, illegal police roadblocks, unauthorized surveillance, and intrusive school policies. Courts sometimes dismiss cases where seized drugs and other evidence were found to be gained by police in violation of appropriate procedures. Efforts to suppress evidence in drug cases is one of the most commonly used defenses.
